IP Infringement Policy

OceanX Ltd respects intellectual property rights and takes infringement claims seriously. This policy explains how to report a claim and how we will respond.
1. Our Commitment to Intellectual Property
OceanX Ltd respects the intellectual property rights of others and expects users of our platforms to do the same. We are committed to responding promptly to notices of alleged copyright infringement and other intellectual property violations that comply with applicable Nigerian law, including the Copyright Act (Cap C28, LFN 2004) and relevant international treaties to which Nigeria is a signatory.
This policy applies to all OceanX Ltd platforms including our website (oceanx-ltd.com) and the NEXA maritime compliance platform.
2. Reporting an Infringement
If you believe that content on any OceanX Ltd platform infringes your intellectual property rights, please send a written notice to our legal team at legal@oceanx-ltd.com containing the following information:
a. Identification of the Work: A description of the copyrighted work, trademark, or other intellectual property that you claim has been infringed.
b. Location of the Infringing Content: A description of where the allegedly infringing material is located on our platform (including a URL where possible).
c. Your Contact Information: Your full name, mailing address, telephone number, and email address.
d. Statement of Good Faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the intellectual property owner, its agent, or the law.
e. Statement of Accuracy: A statement that the information in your notice is accurate and, under penalty of perjury, that you are the intellectual property owner or authorised to act on behalf of the owner.
f. Signature: A physical or electronic signature of the intellectual property owner or a person authorised to act on their behalf.

3. Our Response Process
Upon receiving a valid infringement notice, OceanX Ltd will:
- •Acknowledge receipt of the notice within 5 business days
- •Review the claim and investigate the allegedly infringing content
- •Remove or disable access to the content if we determine the claim is valid, pending resolution
- •Notify the user who posted the content of the takedown where appropriate
- •Respond to the complainant with the outcome of our review within 15 business days
We reserve the right to restore content if we determine the original notice was invalid, incomplete, or submitted in bad faith.
4. Counter-Notice
If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to legal@oceanx-ltd.com containing:
- •Identification of the content that was removed and its previous location
- •A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification
- •Your name, address, and telephone number
- •A statement that you consent to the jurisdiction of the Federal High Court of Nigeria
Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not initiate legal proceedings within 14 business days, we may restore the content at our discretion.
5. Repeat Infringers
OceanX Ltd maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. We also reserve the right to terminate accounts where there is a single serious violation.
Repeat infringer status is determined at the sole discretion of OceanX Ltd based on the number and nature of valid infringement notices received.
6. OceanX Ltd's Own Intellectual Property
All intellectual property on OceanX Ltd platforms — including the NEXA software, OceanX brand assets, logos, website design, written content, and underlying technology — is the exclusive property of OceanX Ltd and is protected under the Nigerian Copyright Act, the Trade Marks Act (Cap T13, LFN 2004), and applicable international treaties.
Unauthorised reproduction, distribution, modification, or commercial use of any OceanX Ltd intellectual property is strictly prohibited and may result in civil and criminal liability under Nigerian law.

7. Trademark Policy
The OceanX and NEXA names, logos, and product names are trademarks of OceanX Ltd. You may not use our trademarks in any of the following ways without our prior written consent:
- •As part of your own product or company name
- •In a manner likely to cause confusion among consumers
- •In any way that implies endorsement or affiliation with OceanX Ltd
- •In connection with products or services that disparage OceanX Ltd
Requests to use OceanX Ltd trademarks should be directed to legal@oceanx-ltd.com.
8. False Notices
Submitting a knowingly false or misleading infringement notice or counter-notice may expose you to civil liability and damages under applicable Nigerian law. OceanX Ltd reserves the right to seek all available legal remedies against parties who abuse this process.
